These Terms constitute a legally binding agreement between you and Maison Éclat ("we," "us," or "our"). Your continued use of the Site following any updates to these Terms constitutes your acceptance of those changes.

2. ELIGIBILITY

3. PRODUCTS AND AUTHENTICITY

Maison Éclat is an online retailer of luxury perfumes and fragrances. We are committed to sourcing and selling only genuine, authentic products. All products listed on our Site are represented as authentic fragrances sourced from third-party suppliers and distributors ("Third-Party Suppliers").

We take commercially reasonable steps to verify the authenticity and quality of our products and to vet our Third-Party Suppliers. However, despite our best efforts, there may be rare circumstances beyond our direct control where a Third-Party Supplier mishandles, mislabels, substitutes, or fraudulently ships a counterfeit or non-conforming product.

4. LIMITATION OF LIABILITY — THIRD-PARTY SUPPLIERS

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE CONSUMER PROTECTION ACT (ALBERTA) AND THE SALE OF GOODS ACT (ALBERTA):

a) Maison Éclat acts as a retailer and reseller of products sourced from independent Third-Party Suppliers. We do not manufacture any products sold on this Site.

b) In the event that a Third-Party Supplier engages in fraudulent conduct, misrepresentation, negligence, or otherwise supplies a counterfeit, mislabeled, or non-conforming product without our knowledge or consent, Maison Éclat shall not be held legally liable for such actions of the Third-Party Supplier.

c) In such circumstances, our total liability to you shall be limited to, at our sole discretion: (i) a full refund of the purchase price paid for the affected product; or (ii) replacement of the product, subject to availability.

d) You acknowledge and agree that by purchasing from this Site, you understand and accept that third-party supply chains carry inherent risks, and that Maison Éclat's responsibility is limited to the actions within our direct control.

e) Nothing in this clause limits any rights you may have under applicable Canadian federal or Alberta provincial consumer protection legislation that cannot be waived or excluded by contract, including any implied conditions under the Sale of Goods Act (Alberta) regarding merchantability and fitness for purpose to the extent required by law.

5. PRICING AND PAYMENT

- All prices listed on the Site are in Canadian Dollars (CAD) or other currencies are subject to applicable taxes.
- We reserve the right to change prices at any time without prior notice.
- Payment must be made in full at the time of purchase.
- We accept payment methods as displayed at checkout.
- We reserve the right to cancel any order where a pricing error has occurred.

6. ORDERS AND CONTRACT FORMATION

Placing an order on our Site constitutes an offer to purchase. A legally binding contract between you and Maison Éclat is formed only upon our confirmation of your order via email. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, product unavailability, or suspected fraudulent activity.

- Estimated delivery times are provided as a guide only and are not guaranteed.
- Title and risk of loss for products pass to you upon delivery to the shipping carrier.
- Maison Éclat is not responsible for delays caused by carriers, customs, or other circumstances beyond our control.

8. INTELLECTUAL PROPERTY

All content on this Site, including but not limited to text, graphics, logos, and software, is the property of Maison Éclat or its licensors and is protected under applicable Canadian intellectual property laws. You may not reproduce, distribute, or use any content from this Site without our express written permission.

9. PROHIBITED CONDUCT

14. SEVERABILITY

These Terms, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and Maison Éclat with respect to your use of this Site and supersede all prior agreements, representations, and understandings.

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site following such changes constitutes your acceptance of the revised Terms.

Customers are solely and one hundred percent responsible for finding / researching / knowing what the ingredients are in the perfume bottle that they choose to buy. Customers can go to the official page and official brand of the perfume that they are buying, they must find and know what the ingredients are from the perfume / fragrance bottles they're buying on maisoneclatscent.com 

Maison Eclat is not responsible for customer's allergies, or any medical conditions that might happen when the customer use the perfume / fragrance bottle without knowing what ingredients was used to make it.

CUSTOMERS ARE RESPONSIBLE FOR RESEARCHING AND KNOWING WHAT THE INGREDIENTS ARE FROM THE ORIGINAL SOURCE / BRAND THAT MADE THEM ON A VERIFIED SOURCE / ORIGINAL VENDOR WEBSITE BEFORE BUYING ON maisoneclatscent.com

Once the customer buys anything on Maison Eclat, they're legally bound and held responsible for whatever might happen to them when using the perfume / fragrance bottles and the customer is legally bound into a contract that cannot be waived, throw aside, overlooked, or take back from once the customer has made a purchase on maisoneclatscent.com they agree to all of our terms of service, policies, and conditions that they are bound to A NON-WAIVABLE CONTRACT THAT CANNOT BE TERMINATED AT ANY POINT BECAUSE THE CONTRACT WILL BE PERMANENT AND FOREVER, AT ANY COST, OR IN ANYWAY!
